SPRINGFIELD The Illinois Department of Financial and Professional Regulation (IDFPR) announced today that Directors of Professional Regulation, Daniel E. Bluthardt; Financial Institutions, Robert Meza; Insurance Michael T. McRaith, and Banking, Jorge A. Solis signed the following disciplinary orders in the month of December 2008.
Banks BANKS AND TRUST COMPANIES Corn Belt Bank and Trust Company, Pittsfield – ordered to cease and desist from engaging in unsafe and unsound banking practices. Strategic Capital Bank, Champaign – amended order to cease and desist from engaging in unsafe and unsound banking practices. West Suburban Bank, Lombard – ordered to cease and desist from engaging in unsafe and unsound banking practices.
Financial Institutions CONSUMER CREDIT The Payday Loan Store of Illinois, Inc., Aurora CILA license (1695) fined $5,300 for the following violations: the payment receipt does not accurately show the required elements, the payment record for a simple interest loan does not show the principal balance due, the date to which interest is paid or itemize other charges collected, repossession file does not indicate a statement of final accounting containing the required information was sent to the borrower, and borrower’s name is not present on the contract. The Payday Loan Store of Illinois, Inc., Burbank CILA license (1529) fined $4,650 for failure to accurately show the required elements on the payment receipt.

PAYDAY LOANS The Payday Loan Store of Illinois, Inc., Calumet City PLRA license (1312) fined $8,100 for the following violations: lender did not enter into the database that the borrower’s loan was paid in full or cancelled on the day the transaction was made, the lender made a payday loan but there is no evidence of a signed, written agreement, loans over 25% of borrower’s income, lender made a payday loan resulting in the borrower having a combined outstanding payday loan principal balance greater than 25% of borrower’s gross monthly income, and security is not released. The Payday Loan Store of Illinois, Inc., Waukegan PLRA license (1313) fined $4,800 for the following violations: lender did not obtain any official documentation of the borrower’s income before making a payday loan, loans over 25% of borrower’s income, Lender made a payday loan resulting in the borrower having a combined outstanding payday loan principal balance greater than the 25% of borrower’s gross monthly income, a partial payment on a PLRA loan or repayment plan was not entered into the database on the date the transaction was made, and official income documentation was not the required type for a payday loan or was not for income for the 30 days preceding the loan.
